Terms of Service

1. Agreement to Terms

By accessing or using the White Bridge website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

2. Description of Service

White Bridge provides background scoring, identity verification, and risk assessment tools. Our service aggregates public records, financial signals, and social data to provide a comprehensive "Bridge Score" for individuals and entities. This information is intended to assist in decision-making processes but should not be the sole basis for critical life-altering decisions without proper verification.

3. Eligibility

You must be at least 18 years of age to use this Service. By agreeing to these Terms, you represent and warrant that you are of legal age and have the capacity to form a binding contract. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

5. Subscription and Payments

Certain parts of the Service are billed on a subscription basis or per-report basis. You will be billed in advance on a recurring or one-off basis. A valid payment method is required to process the payment for your Service. We use secure third-party payment processors and do not store your raw credit card information on our servers.

Refunds are handled on a case-by-case basis. Given the nature of data delivery, once a report has been generated and accessed, refunds are generally not provided unless there is a demonstrable technical failure or significant data error that prevents the use of the report.

6. Acceptable Use Policy

You agree not to use the Service for any purpose that is prohibited by these Terms. You are responsible for all of your activity in connection with the Service. You shall not (and shall not permit any third party to): (a) take any action that imposes or may impose an unreasonable or disproportionately large load on our infrastructure; (b) interfere or attempt to interfere with the proper working of the Service; (c) bypass any measures we may use to prevent or restrict access to the Service.

Furthermore, you explicitly agree not to use White Bridge data for: (1) unlawful stalking or harassment; (2) unauthorized credit or insurance underwriting; (3) employment screening that violates the FCRA; (4) any form of discrimination.

7. Intellectual Property

The Service and its original content (excluding content provided by users), features and functionality are and will remain the exclusive property of White Bridge and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of White Bridge.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact support.

9. Limitation of Liability

In no event shall White Bridge, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

10. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. White Bridge does not warrant that the Service will function uninterrupted, secure or available at any particular time or location.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Indemnification

You agree to defend, indemnify and hold harmless White Bridge and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, shall constitute the entire agreement between you and White Bridge concerning the Service. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
